Fred Weber Inc. is acting irresponsible for attempting to sue Tom Diehl of Oakville — "Senate panel hears testimony from local man on SLAPP bill;" published in the Feb. 17 issue of the Call.
Fred Weber has become notorious for using the justice system against anyone who opposes its project and it is violating Mr. Diehl's constitutional rights to a trial in federal court. The company has already damaged its own reputation for filing a lawsuit against common citizens opposing its point of view.
At the same time, the citizens of Oak-ville have the constitutional right to oppose Fred Weber's position.
Mr. Diehl was using political speech and not commercial speech.
The First and Fourth amendments of the U.S. Constitution prohibit states and state courts from censoring a person for opposing a political point of view.
As a result, the St. Louis County Courts should lack the jurisdiction to hear the case.
